TERMS AND CONDITIONS FOR PARTICIPATION

GENERAL INFORMATION

Under the auspices of and in collaboration with the genuine rightsholder HYROX World GmbH, Hamburg/Germany (“HYROX World”), which is responsible for the overall management and international coordination of the event “HYROX – the World Series of Fitness Racing”, HYROX SEE Sportif Organizasyon A.Ş. with registered offices at Esentepe Mah. Büyükdere Cad. Levent 199 No: 199 Iç Kapı No: 6 Şişli / İstanbul (“Local Organiser” or “we” or “us”), organises, manages, stages and delivers HYROX and HYROX YOUNGSTARS fitness races and related events within the territory of Republic of Türkiye (“Territory”) (“Event”) as the local event Organiser.

HYROX fitness races are conducted in an event-series format in various cities around the world, with Regional Championships and World Championship as the respective season’s highlight and ending. The races operate in seasons, where a “season” shall mean the period of time commencing on the first day after the World Championship event and ending with the conclusion of the following World Championship event.

HYROX fitness races are open to participants aged 18 and over and are generally organised as follows:

as an individual competition (“Single Division”) in HYROX PRO MEN/PRO WOMEN, HYROX MEN/WOMEN, and HYROX ADAPTIVE MEN/ADAPTIVE WOMEN;

as a partner competition (“Doubles Division”) in HYROX DOUBLES MEN/WOMEN/MIXED, HYROX PRO DOUBLES MEN/WOMEN; and

as a relay competition (“Relay Division”) in HYROX RELAY MEN/WOMEN/MIXED

The regulations of the HYROX Rulebook (available at: www.hyrox.com) (the “HYROX Rulebook”) apply to athletes of the races at each Event.

THESE TERMS & CONDITIONS

These terms and conditions (“T&Cs”) set out and comprise the legal terms applying between the Local Organiser and purchasers of Event tickets or Event participants whether as an athlete, spectator or otherwise (“Participant” or “you”) in relation to your registration to participate and your participation in an Event.

By making a purchase for or participating as an Athlete in an Event, subject to the foregoing, you warrant that you are at least 18 years old (or the age of legal capacity in the country of purchase) and are able to enter into legally binding contracts. Children under the age of 18 and incapacitated adults may only participate in an Event as a spectator if a parent or legal guardian has accepted these T&Cs on their behalf. Where you are registering a child under the age of 18 or an incapacitated adult as a Participant:

you represent and warrant that you are the parent or legal guardian of that person;

you represent and warrant that you have the legal authority to consent to their participation in the Event and enter into these T&Cs on their behalf; and

you acknowledge and agree that any breach of these T&Cs by them will be deemed as a breach of these T&Cs by you.

We reserve the right at our discretion to amend these T&Cs (and the format, date and structure of any Event), including if there is a change in the applicable laws, legislation, regulations, ruling or omission of any relevant government, court, competent national authority or governing body or amendments due to changes in the event structure. If we do implement such changes, we will notify you of any such changes in advance.

Any person who is in breach of these T&Cs may be removed from an Event without the right to refund, compensation or re-admission. Please note, any specific terms stated at the point of ticket purchase shall take precedence over these Terms.

AGE POLICY

No unaccompanied under 16s are allowed at the Event. All under 16s must be accompanied by an adult ticket holder (aged over 18) at all times.

Under 12s are admitted free but require child tickets in order to attend an Event. Over 12s must have a full price ticket to attend an Event.

Where your child or dependent is participating in a race, it is your responsibility to ensure that your child/dependent is not left unaccompanied before or after their race. We reserve the right to disqualify and/or exclude you from participating in an Event at any time if you have left your child/dependent unattended.

We do not accept any parental or supervisory duty of care or liability for any under 18s at an Event.

Further age restrictions may apply to certain Events. Admission to after party Events (where available) is restricted to individuals aged over 18.

TICKETS, PRICING, PAYMENTS AND CONCLUSION OF CONTRACT

Events have a limited capacity, therefore tickets for popular Events may sell out quickly. Prices may vary depending upon geographic markets, availability, selected start time window, venue requirements and/or regulations, and we reserve the right to change prices at any time.

Unless otherwise indicated, all listed prices on our registration page are stated to be inclusive of VAT or sales taxes. Ticket prices include a service fee for processing and administration (“service fee”) and, if applicable, a fee for flex options chosen (“Flex fee”). Service fees and Flex fees are non-refundable, unless otherwise stated in these terms and conditions.

Payment methods vary and the accepted payment methods are as stated on the platform where your ticket is purchased.

Vivenu, Inc. (“Vivenu”) acts as the service provider for the Local Organiser in connection with the registration process for the Events.

Purchases are subject to credit card approval, and are processed only after a billing address, and other billing information, has been verified. Occasionally, we receive incorrect billing or credit card account information for a purchase that can delay processing and delivery. In these cases, our customer services will attempt to contact you, using the information provided at the time of purchase. If we are unable to reach you after our initial attempt, we may cancel your order without further notice (in which case you will not be charged).

If you do not receive a confirmation email after submitting payment information, or if you experience an error message or service interruption after submitting payment information, it is your responsibility to confirm via HYROX customer service whether or not your order has been placed. Only you may be aware of any problems that may occur during the purchase process. We will not be responsible for technical faults or any losses (monetary or otherwise) if you assume that an order was not placed because you failed to receive confirmation.

Once we confirm your purchase by email, a binding contract is entered into between us for you to participate in or attend the relevant Event in accordance with, and subject to, these T&Cs (to the exclusion of all other terms and conditions save where expressed to the contrary in these T&Cs).

If payment is not processed for any reason whatsoever, the Local Organiser is entitled to terminate the contract immediately without liability. You shall be liable for all costs reasonably associated with such termination.

Where available, discount or payment codes issued by us are accepted as a form of payment for registration, subject to any applicable terms and conditions. Discount or payment codes issued are personal to the recipient and may not be transferred, sold, or assigned to any other person or third party.

If you are a consumer located in a jurisdiction where local laws grant you specific rights of cancellation, refund, or withdrawal that cannot be excluded by contract, those statutory rights shall take precedence over these T&Cs. You acknowledge and agree that these T&Cs relate to services for a leisure activity to be provided on a specific date or period, and statutory rights of withdrawal (and “cooling-off periods”) do not apply in certain jurisdictions.

Payment processes for HYROX ticket sales are carried out by third-party payment service providers. Due to these providers’ compliance obligations under MASAK and international AML regulations, payments may not be possible from certain locations or with certain cards. HYROX World and the Local Organiser bear no responsibility in this regard.

TICKET CONDITIONS, REFUNDS AND CHANGES

Before completing any purchase, you should carefully review your purchase. We offer a 24-hour refund policy for unused tickets purchased online. After 24-hours, sales are final and purchases are not refundable except as expressly set out in these T&Cs.

Once purchased, purchases cannot be transferred, exchanged, refunded or returned, except as detailed in this Section 5.

The following terms apply to tickets for the Event:

Athlete Standard

(Non-Flex)

No returns, refunds, transfers or changes, including to athlete name, division, event or age group selected.

Athlete Lite Flex

No returns or refunds.

One (1) name change per athlete per ticket (to a person of the same gender) may be made up to 7:59am (Event time zone) one day before your race.

No changes may be made to the division, event or age group selected at any time.

Not available for World Championship Tickets

Athlete World Championships

By invitation only.

In the Doubles Division, one (1) name change per ticket (to a person of the same gender and same age group) may be made where one athlete is unable to compete due to proven illness or injury, provided a valid medical certificate is presented and subject to HYROX’s approval in its sole discretion. HYROX will not be able to accommodate any personalised items for late changes (less than 4 weeks before race date).

Except as provided above, no returns, refunds, transfers or changes are permitted, including to athlete name, division or the event selected.

Spectator / Other

No returns, refunds or changes, including to the event selected.

In relation to Adaptive tickets, “adaptive” athletes are defined under the HYROX Rulebook. If an athlete purchases an adaptive ticket and the Local Organiser in its sole discretion determines they do not fall under any adaptive definition, the Local Organiser has the right to cancel the purchase and refund the fee, with no further liability to you. You must exercise cautious judgment when purchasing and if uncertain, first contact us at (https://hyrox.com/contact/) before purchasing.

Where permitted by ticket terms, any name changes must be made online via your HYROX account.

It is your responsibility to ensure that you can participate in the Event for which you purchased a ticket and we will not be responsible for your inability to participate for any reason. For example, if you have purchased tickets for two different races on the same day, we will not be liable if you cannot participate in both races because the race times overlap.

UNLAWFUL RESALE OF TICKETS

Unlawful resale (or attempted resale), counterfeit or copy of Event tickets or promotional codes are grounds for seizure and cancellation without compensation. You are responsible for complying with all applicable ticket resale laws. Promotional codes or passes may not be used for advertising, promotions, contests, or sweepstakes, unless formal written authorisation is given by us.

ADDITIONAL THIRD-PARTY PRODUCTS

Event Photography (Sportograf)

Event photography is provided by Sportograf Digital Solutions GmbH, whose registered office is at 170 Süsterfeldstrasse, 52072, Aachen, Germany (“Sportograf”). If you choose to purchase Sportograf products, you agree to be bound by the terms and conditions of Sportograf which can be found at https://www.sportograf.com/en/agb in addition to these T&Cs and that any use of your personal data shall be subject to Sportograf’s privacy policy.

You acknowledge that the Local Organiser acts as an agent for the sale of the Sportograf product. To the maximum extent permitted by law, the Local Organiser disclaims all liability for any defects, delays, or issues arising from the Sportograf product. Any claims or disputes regarding the Sportograf product must be directed to Sportograf.

EVENT REGISTRATION & PARTICIPATION

The Local Organiser reserves the right to disqualify and/or exclude you from participating in and/or attending an Event at any time and without any right to a refund if:

you have failed to personalise your ticket before the Event;

you do not possess a valid ticket;

you provide us with false information or fail to provide proof of identity/ age;

there is reasonable suspicion that you are not in generally good health or physical condition or if you are showing any typical symptoms of illness (including but not limited to shortness of breath, coughing or fever);

there is reasonable suspicion that you are in possession or under the influence of any illicit substances (performance-enhancing or otherwise) at the time of any Event, or

your actions and/or omissions (whether before, during or after any Event) in the opinion of the Local Organiser or owner of the Event venue endanger the safety of the Event, its Participants or violate any Event Rules.

“Event Rules” shall mean all applicable laws, posted rules and warnings, safety announcements, event and venue policies and regulations (including but not limited to the HYROX Event Code of Conduct) provided or notified to you by the Local Organiser and/or the owner of the Event venue (the “Venue Owner”).

You understand and agree that you are expected to exhibit appropriate behaviour at all times while at the Event, to obey the Event Rules and abide by any decision of any Event official relative to your ability to safely participate in or attend the Event. This includes, generally, respect for other people, equipment, facilities, or property.

For access control reasons, we may provide Participants at certain Events with electronic wristbands containing a RFID chip. The RFID chip contains digital information confirming the Participant’s authorisation to access the Event as well as the functionality to be used for cashless payment. The terms and conditions governing your use of the RFID wristband are set out in the Annex.

You may take your own photographs, audio recordings or video footage at the Event for private and personal use only. You must not publish, post, distribute, sell, license, commercially exploit or use any such material in a manner which could misrepresent, harm or negatively impact the Event, the Participants, HYROX or its partners. HYROX may request removal of any content that breaches this condition, and you agree to comply promptly with any such request.

You shall not plan, organise, lead, promote or endorse any commercial activity relating to your, if any, own business or the business of a third party that is not contracted to the Local Organiser or HYROX World in connection with the Event and/or as a HYROX sponsoring partner.

Athlete Terms

By participating in the Event, you accept that your participation is governed by the HYROX Rulebook and you are bound by its terms.

In addition to its rights under clause 9.1 above, the Local Organiser reserves the right to disqualify and/or exclude you from participating in an Event at any time and without any right to a refund if:

you provide false personal information to us during registration, including information regarding your biological gender at birth and nationality (where applicable);

you do not possess a QR-/barcode assigned to your ticket and an official start number;

you do not meet the eligibility requirements for the race that you are registered for;

for Elite 15 athletes, you fail to hold and produce a valid Athletes License granted to you by HYROX World for the corresponding season; or

where applicable, you are suspended by another sports or anti-doping organisation.

You must check your starting documents for completeness upon receipt. The timing chip, contained in the starting documents, must be returned to the Event staff in the finish area immediately after crossing the finish line. If the timing chip is lost or damaged, the Local Organiser reserves the right to recover from you all attributed costs summing up to an amount equalling USD 100 (US dollar one hundred) in local currency.

We will notify you of your race time and start wave before the Event. You will not be allowed to participate if you miss your race time or start wave.

You acknowledge and agree that, as stated in the applicable HYROX Rulebook, official rankings are based on athletes’ biological gender at birth, in line with Olympic guidelines. Individuals who wish to register under a gender different to their gender at birth may participate recreationally but may not be included in any official rankings.

Assumption of risk & medical care

Participation in any Event is at your own risk and requires that you are healthy and in good physical condition. It is your responsibility to check your health beforehand. With your registration, accreditation and participation, you expressly declare that you are aware of the specific dangers of the Event and that there are no health concerns regarding your participation. We reserve the right at any time to request confirmation on the state of your health and you agree to disclose your state of health (including supporting confirmation from a qualified medical professional, for example in the form of a doctor’s note) on such request.

You acknowledge and agree that: (i) your physical condition and/or state of health may change during the period between registering to participate in an Event and the participation (including but not limited to viral infection, illness, injury or pregnancy); and (ii) you bear this risk alone and you are not entitled to a refund if you cannot participate due to subsequent changes to your physical condition and/or state of health.

In relation to medical matters, you agree that:

If you become ill during or after an Event and/or receive medical attention or treatment either from medical staff, other medical service providers to the Events as contracted by the Local Organiser, or any doctor or hospital, you authorise such persons to provide details (including details of medical treatment) to the Local Organiser or others authorised by them; and

you consent to medical assistance and/or medical care being given to you in the case of illness, injury or an emergency situation, should this occur during an Event, such assistance to be given by the Local Organiser, its employees, contractors or other trained personnel conducting the Events (which may include the use of anaesthetics).

SAFETY AND SECURITY

You and your belongings may be searched on entry to or at the Event. You consent to such searches and waive any related claims that may arise. If you elect not to consent to such searches, you may be denied entry to or ejected from the Event without refund or other compensation. Certain items may not be brought onto the premises of any Event Venue, including without limitation, alcohol, drugs, controlled substances, firearms, or knives.

You understand and agree that you are responsible for taking care of your own belongings during the Event and, to the maximum extent permitted by law, neither The Local Organiser nor the Venue Owner is responsible for any personal item or property that is lost, damaged or stolen at the Event.

The carrying and bringing of animals to Events is prohibited, with the exception of guide dogs.

FORCE MAJEURE EVENT, POSTPONEMENT AND CANCELLATION OF THE EVENTS

Local Organiser is under no obligation to hold the Events in its entirety or in parts and, subject to the remainder of this clause 10, may without further liability postpone or cancel the Event in full or in part, or change the time or location of, any or all of the Events for any reason, including due to:

circumstance not within the Local Organiser’s reasonable control, including but not limited to severe weather conditions, natural disasters (such as floods, hurricanes, earthquakes, or fires), epidemics, pandemics, global health crises, war, terrorism, civil unrest, labor disputes, strikes, government actions, embargoes, power failures, economic impossibility and low entry numbers;

on advice of any security or police force, health authority and/or local authority consent or approval (or withdrawal of such consent or approval) or for any reason that would affect the safety and security of Participants, or the feasibility of the Event to be held; or

any changes to applicable Laws, legislation, regulations, ruling or omission of any relevant government, court, competent national authority or governing body,

(“Force Majeure Event”).

If any Event for which you are registered is cancelled or postponed due to a Force Majeure Event or for any other reason, you shall be entitled to a free rebooking at a next year’s edition of the same Event. If you are unable to attend that Event, you have 30 days to inform us in writing and you may request a free rebooking to an alternative Event of your choice taking place within the region during the same or next season (subject to availability).

If your race during the Event for which you are registered is cancelled for whatever reason, the Local Organiser (may at its reasonable discretion) either repeat the affected race the same day or on another day during the same Event. In such circumstances, the ranking or the athlete’s position during the unfinished race shall not apply or be taken into consideration.

Under no circumstances will we be liable for travel, accommodation or any other expenses that you or anyone else incurs in connection with a cancelled or postponed Event, or any deferral.

We reserve the right to alter the start time of the Event. In the event of a change of start time you will be notified of the revised start time with as much notice as reasonably practicable. No refund in full or in part shall be made for any change in start time for the Event, provided the Event takes place on the specified date of the Event.

We reserve the right to amend the Event format, including changing the course and the distance, at our sole discretion. If the Event format, course, or distance, is changed, you will not be entitled to any refund and there shall be no further liability whatsoever arising from such change of format, course, or distance.

ASSUMPTION OF RISK, WAIVER AND LIMITATION OF LIABILITY

You understand and agree that there are certain risks inherent in attending any event, including a sporting event, and voluntarily assume all risk of property loss or damage, personal injury, illness and/or death arising in connection with the your attendance at the Event (e.g., by entering the venue and/or attending the Event), including, without limitation, objects or fragments thrown or flying into the spectator area, a venue’s stands, concourses and/or concession areas during an Event, special effects at an event, acts or omissions of other spectators and risks related to any resulting disease. You understand and agree that these risks cannot be fully eliminated.

You voluntarily assume all known and potential risk and danger of property loss, illness (including sickness, whether airborne or otherwise, and other risks of exposure to any communicable disease or illness or a bacteria, virus or other pathogen capable of causing a communicable disease or illness), injury and/or death from any cause, resulting from, in connection with, or incidental to the Event, whether occurring prior to, during or after the Event. You agree that the Releasees (defined below) shall not be responsible or liable for any claim, loss, damage or injury, whether occurring before, during, or after the event, regardless of whether caused by the negligence or other fault of Releasees or any third party.

To the fullest extent permitted by applicable law, you hereby expressly waive and release any and all claims, now known or hereafter known in any jurisdiction throughout the world, against the Local Organiser, HYROX World, and their respective officers, directors, manager(s), employees, agents, affiliates, shareholders/members, successors, and assigns (collectively, “Releasees”), on account of injury, disability, death, or property damage arising out of or attributable to your attendance at the Event, whether arising out of the negligence of the Local Organiser or any Releasees or otherwise. You covenant not to make or bring any such claim against the Local Organiser or any other Releasee, and forever release and discharge the Local Organiser and all other Releasees from liability under such claims.

To the maximum extent permitted by law, we (including our affiliates, parent undertakings, subsidiaries, and their respective officers, directors, employees, agents, legal representatives and sub-contractors) and our partners shall not be liable for any loss, injury or damage to any person (including you) or property howsoever caused:

in any circumstances where there is no breach of contract or a legal duty of care owed by us or our partners; and

in circumstances where such loss or damage is not directly as a result of any such breach (save for death or personal injury resulting from our or a partner’s negligence).

Subject to Section 11.6 below, you agree that:

the Local Organiser shall not be liable to you for any reason under or in relation to these T&CS, or an Event for any: (i) loss of profit; (ii) loss of reputation; (iii) loss of data; (iv) loss of business, revenue or goodwill; (v) loss of anticipated savings; (vi) pledges made on your behalf or by you to a charity; (vii) your travel, accommodation or other expenses incurred in relation to any cancelled or postponed Event; (viii) any other indirect or consequential loss or damage, in each case regardless of whether such loss or damage is reasonably foreseeable or is in the contemplation of parties; and

the Local Organiser’s maximum liability to you, for any reason or cause whatsoever, shall not exceed the total amount of monies received by the Local Organiser from you.

Nothing in these T&Cs shall be construed as limiting or excluding the Local Organiser's liability for: (i) death or personal injury resulting from negligence; (ii) fraud or fraudulent misrepresentation or (iii) any other matter for which it would be illegal or unlawful to limit, exclude or attempt to exclude liability. Your statutory rights as a consumer are not affected by these T&Cs.

The Local Organiser takes no responsibility for allergens contained in food and drink provided at the Event.

PRIVACY AND DATA PROTECTION

We process and share your personal data with our partners in accordance with our privacy policy which can be found on our website.

Provided you give us prior permission, HYROX World and its affiliated companies and partners and/or third parties may contact you, to provide you with newsletters and other communications regarding HYROX’s or such third parties’ products, services and events. These messages will be sent to you based on your messaging preferences and you can unsubscribe at any time.

RECORDING, TRANSMISSION AND EXHIBITION

You agree that the Event is a public event, that your appearance and actions inside and outside the venue where the Event occurs are public in nature, and that you have no expectation of privacy with regard to your actions or conduct at the Event.

You hereby grant permission to (i) the Local Organiser, HYROX World, members of its group, its partners and its affiliates (“HYROX Parties”), (ii) any parties authorised by or acting on behalf of the HYROX Parties, and (iii) accredited members of the media, to film, capture and record your participation in the Event. Such permission includes the right to photograph, film, record and/or otherwise capture your name, image, likeness, voice, written statement, photograph and/or any other biographical information, in any media format.

You acknowledge and agree that any and all photographs, video, film, motion pictures, recordings and content captured during the Event by or on behalf of the HYROX Parties shall be their sole property. You acknowledge and agree that such photographs, motion pictures, recordings and content containing your name, image, likeness, voice, written statement, photograph and/or any other biographical information may be edited, exhibited, disseminated, adapted, modified, copied, used and/or exploited by the HYROX Parties, in whole or in part, in all media and formats, throughout the world, in perpetuity, for any legitimate commercial or non-commercial purpose, including but not limited to promoting, advertising and marketing HYROX products and services and the events held by the HYROX Parties, without prior notice, approval or compensation.

If you have concerns regarding your image being used in our materials, please contact HYROX Customer Services or visit the Registration Desk on the day of the Event. We will make reasonable efforts to accommodate your request but cannot guarantee complete exclusion from all group or background imagery.

HYROX INTELLECTUAL PROPERTY RIGHTS

HYROX World is the sole owner of the trademark "HYROX," and all related intellectual property rights relating to HYROX – The World Series of Fitness Racing, including but not limited to any brand logos, guides, documents created by HYROX World as well as images, audio-visual recordings (e.g., highlights, clips, snippets) produced at the Event or by any authorised third party (together “HYROX IP”).

You are not permitted to use the HYROX IP without the express written consent of HYROX World.

Nothing in these T&Cs grants you the right to use or reproduce the HYROX name or logo in any manner that implies a partnership, sponsorship, endorsement, or affiliation with HYROX.

GENERAL

The Annexes set out any additional terms which may apply.

These T&Cs have been drafted in the English language and may be translated into other languages. In the event of any discrepancy between the English and any translated version, the English language version shall prevail.

The contract between us constitutes the entire agreement between the parties and no party shall have any claim or remedy in respect of any statement, representation, warranty or undertaking, made by or on behalf of any other party in relation to our contract which is not already set out in these T&Cs.

If any term, condition or other provision of these T&Cs are determined by a court of competent jurisdiction to be invalid, illegal or incapable of being enforced by any rule of law or public policy, it shall be deemed to be deleted from these T&Cs, and all other terms, conditions and provisions of these T&Cs shall nevertheless remain in full force and effect.

Nothing in these T&Cs shall exclude or limit any rights which a consumer may have under applicable mandatory consumer protection laws in the country in which the Event takes place, to the extent such rights cannot lawfully be excluded or limited.

GOVERNING LAW & JURISDICTION

These T&Cs, and any dispute or claim (including non-contractual disputes or claims) arising out of or in connection with them, shall be governed by and construed in accordance with the laws of the Republic of Türkiye

You may apply, in accordance he Law on the Protection of Consumers numbered 6502 and the relevant legislation to Consumer Arbitration Committees and Consumer Courts, and pursuant to the Terms and Conditions, the courts and enforcement offices of İstanbul (Çağlayan) shall have exclusive jurisdiction to settle any dispute or claim arising out of or in connection with these T&Cs.

ANNEX: RFID WRISTBAND TERMS

GENERAL INFORMATION

You may receive wristbands equipped with an RFID chip for the purposes of admission and access control and to provide an option for the cashless payment for goods and services (hereinafter referred to as "RFID chip") at an Event and these terms shall apply to the RFID chip received.

Each RFID chip is issued for a specific Event only. It cannot be used outside of this specific Event as an access authorisation or for payment. In particular, it cannot be used at other Events organised by us.

OUR PARTNERS

To enable you to use RFID chips, we cooperate with the service provider Global Event Technologies GmbH, with registered office at Am Ausferngenufer 8, 5400 Hallein, Austria (hereinafter referred to as "GET"). GET performs the following tasks in particular:

Provision of hardware for the admission and access control carried out by us;

Providing the online platform through which Participants can, for example, top up credit and view their transactions (hereinafter referred to as "Event Portal").

In addition, we cooperate with the licensed payment service provider Adyen N.V., with registered office at Simon Carmiggeltstraat 6-50, 1011 DJ, Amsterdam, the Netherlands, to process top-ups, payments and refunds. GET acts as a technical service provider on behalf of Adyen N.V.

Contractual relationships and claims of Participants with regard to the issuance and use of RFID chips, the use of the Event Portal, and the management and disbursement of credit stored on the RFID chip will be concluded and established exclusively with and against us.

ISSUANCE AND GENERAL USE OF RFID CHIPS

RFID chips will be handed out to Participants upon arrival at the Event premises.

The RFID chips must be attached and securely fastened in accordance with our instructions. If you have any difficulties attaching an RFID chip, please ask the staff at the issuing point for assistance.

Participants must keep their RFID chips safe until the end of the Event, treat them with care and protect them from theft, loss and misuse. The RFID chip contains sensitive electronics and must not be exposed to external magnetic fields in order to prevent data loss or malfunction of the RFID chip. The RFID chip must not be modified or opened. Independent reading or modification of the data stored on the RFID chip is prohibited.

After the end of the Event, the RFID chip may remain with the respective Participants and there is no obligation to return the RFID chip.

We are not liable for the loss, theft, misuse or other unauthorised use of the RFID chip, unless we are at fault in the individual case.

Any theft, loss or misuse of the RFID chip, as well as malfunctions or defects, must be reported to the staff at the issuing point immediately after becoming aware of it. If and to the extent necessary, the staff at the issuing point will deactivate the affected RFID chip and issue a new RFID chip free of charge. The credit stored on the affected RFID chip can be transferred to the new RFID chip or refunded. For this purpose, the staff at the issuing point will verify the identity of the affected Participants. This verification will usually require the RFID chip number on the back of the RFID chip and the presentation of an identity document. In the event of theft, loss or damage to the RFID chip or the RFID chip number, we are not obliged to enable a transfer or refund without the RFID chip number being provided. However, we will make reasonable efforts to enable a refund based on other identification features.

We may deactivate an RFID chip if there are objective reasons related to the security of the RFID chip that justify this or if there is suspicion of unauthorised or fraudulent use of the RFID chip. We will immediately notify the Participants affected by the deactivation of the RFID chip via the email address provided by the respective Participants during the process of personalisation for their ticket. If and to the extent necessary, the staff at the issuing point will issue a new RFID chip free of charge (after identifying the respective Participants, if necessary) and transfer the stored credit.

ADMISSION AND ACCESS CONTROL

Participants will receive an RFID chip upon arrival at the Event venue. The RFID chip will contain digital information confirming the holder's authorisation to participate in or enter the Event (in accordance with the ticket purchased and the provisions of the T&Cs).

The RFID chip serves as proof of participation or access entitlement for Participants throughout their visit to the Event. Participants can prove their access entitlement by scanning the RFID chip at the designated access points.

The information on the RFID chip regarding the participation and access entitlement of the respective Participants is personalised. The RFID chip may therefore not be used to grant other persons access to the event.

CHARGING AND REFUNDING CREDIT

The RFID chip can be used by Participants for cashless payment within the scope of the Event.

For this purpose, the RFID chip can be topped up with credit either online via the Event Portal or on site at top-up stations (hereinafter referred to as "Top-up Stations"). The payment methods (e.g. debit and credit cards, PayPal etc.) that can be used for topping up are specified in the information provided on the Event Portal and at the Top-up Stations. Information about the credit balance and payment transactions made with the RFID chip can also be accessed via the Event Portal. This requires Participants to create an account linked to the RFID chip.

The RFID chip can only be topped up in the currency of the Territory.

The credit stored on the RFID chip is assigned to a specific Participant and cannot be transferred to other persons.

The minimum top-up amount is € 10.00. The maximum top-up amount (even in the case of multiple top-ups) for each RFID chip is € 250.00 per month.

No interest is paid on credit balances.

If Participants become aware that their respective RFID chip has a higher credit balance than has actually been topped up by the respective Participant, they must notify us immediately. These excess amounts may not be used to purchase goods or services. Otherwise, the Participant is obliged to reimburse the amounts concerned (even if they have already been spent).

CASHLESS PAYMENT FOR GOODS AND SERVICES

We and various other providers (both we and the other providers in this function hereinafter referred to as "Providers") independently offer goods and services to Participants within the framework of our Event.

Goods and services are offered and sold by the respective Provider in their own name and on their own account. The sole contractual partner of Participants with regard to the purchase of such goods and services is the respective Provider. We are not involved in the sales of other Providers unless we are expressly identified as the seller at the sales stand, in the offers or on the invoices. If you have any questions or complaints about a purchased good or service, please contact the respective Provider directly.

The credit stored on an RFID chip can be used within the Event premises to purchase goods and services at specially designated locations (hereinafter referred to as "Acceptance Point"). We do not guarantee that payment for goods and services at Acceptance Points using the RFID chip will be possible in all cases.

In order to use the credit stored on an RFID chip for payment, Participants must bring their respective RFID chip into close proximity to the POS device located at the Acceptance Point. The POS device will automatically read the RFID chip (via near field communication) as well as check and verify the data stored on the RFID chip, including the amount of credit available.

Once the data has been successfully checked and verified, the purchase or service contract between the Participant and the respective Acceptance Point is concluded, with the payment owed being deducted from the available credit stored on the RFID chip. With each purchase, the credit stored on the RFID chip is reduced by the amount owed. After the RFID chip has been successfully used for the payment transaction, Participants cannot unilaterally reverse the transaction and payment process.

Payment transactions are carried out without authorisation checks by the Acceptance Points. However, we reserve the right to reject individual transactions if the RFID chip in question is deactivated or if there is reasonable suspicion that the RFID chip is being used to carry out an unauthorised or fraudulent transaction.

Any refunds (e.g. in the event of complaints against Acceptance Points) will be made by crediting the balance stored on the RFID chip.

TERMINATION OF THE USER RELATIONSHIP, REFUND OF REMAINING CREDIT

After the end of the Event, any remaining credit stored on the RFID chip will be automatically refunded free of charge within 14 days. The remaining credit will be refunded to a payment method used by the respective Participant to top up the RFID chip. The respective claim for a refund arises at the end of the Event.

The user relationship between Participants and HYROX World with regard to the use of the RFID chip ends with the refund of the entire remaining credit by HYROX World to the respective Participants or Spectators.

In the event of good cause, the contractual relationship may be terminated with immediate effect by both the respective Participant or Spectator and by us.

KATILIM ŞARTLARI VE KOŞULLARI

GENEL BİLGİLER

“HYROX – Fitness Yarışları Dünya Serisi” etkinliğinin genel yönetimi ve uluslararası koordinasyonundan sorumlu olan Almanya/Hamburg merkezli HYROX World GmbH (“HYROX World”) himayesinde ve iş birliğiyle, merkezi Esentepe Mah. Büyükdere Cad. Levent 199 No:199 İç Kapı No:6 Şişli/İstanbul] adresinde bulunan HYROX SEE Sportif Organizasyon A.Ş. (“Yerel Organizatör” veya “biz”), Türkiye Cumhuriyeti sınırları (“Bölge”) içerisinde HYROX ve HYROX YOUNGSTARS fitness yarışlarını ve bunlara bağlı etkinlikleri düzenler, yönetir ve yürütür (“Etkinlik”).

HYROX fitness yarışları, dünyanın farklı şehirlerinde düzenlenen bir etkinlik serisi formatında gerçekleştirilir. Her sezonun zirvesi ve kapanışı Bölgesel Şampiyonalar ve Dünya Şampiyonasıdır. “Sezon” ibaresi; Dünya Şampiyonası’nın yapıldığı günü takip eden ilk günden başlayarak bir sonraki Dünya Şampiyonası’nın tamamlanmasına kadar geçen süreyi ifade eder.

HYROX yarışları 18 yaş ve üzeri katılımcılara açıktır ve genel olarak aşağıdaki kategorilerde düzenlenir:

Bireysel yarış (“Single Division”): HYROX PRO MEN/PRO WOMEN, HYROX MEN/WOMEN, HYROX ADAPTIVE MEN/ADAPTIVE WOMEN

Çiftli yarış (“Doubles Division”): HYROX DOUBLES MEN/WOMEN/MIXED, HYROX PRO DOUBLES MEN/WOMEN

Bayrak yarışı (“Relay Division”): HYROX RELAY MEN/WOMEN/MIXED

HYROX Kural Kitabı’nda (www.hyrox.com adresinde mevcuttur) yer alan düzenlemeler (“HYROX Kural Kitabı”), her bir Etkinlikteki yarışlara katılan sporcular için geçerlidir.

ŞARTLAR VE KOŞULLAR

İşbu Şartlar ve Koşullar (“Sözleşme”), Yerel Organizatör ile etkinlik bileti satın alan veya etkinliğe katılan kişiler (“Katılımcı” veya “siz”) arasındaki hukuki ilişkiyi düzenler.

Bir Etkinlik bileti satın alarak veya bir Etkinlik’e atlet olarak katılım sağlayarak, yukarıdaki hükümlere tabi olmak kaydıyla, en az 18 yaşında olduğunuzu (fiil ehliyetine sahip olduğunuzu ve hukuken bağlayıcı sözleşmeler akdetme ehliyetine sahip bulunduğunuzu) beyan ve taahhüt edersiniz. 18 yaşın altındaki çocuklar izleyici olarak ile fiil ehliyeti bulunmayan yetişkinler, yalnızca ebeveynleri veya yasal vasileri tarafından işbu Sözleşme’nin kendi adlarına kabul edilmesi halinde bir Etkinlik’e katılım sağlayabilirler. 18 yaşının altındaki bir çocuk veya fiil ehliyeti bulunmayan bir yetişkin Katılımcı olarak velisi/vasisi tarafından Ekinlik’e kaydolursa:

İlgili kişinin velisi/vasisi olduğunuzu,

Katılım için gerekli hukuki yetkiye sahip olduğunuzu,

Bu kişinin ihlallerinden sizin sorumlu olacağınızı kabul edersiniz.

Yerel Organizatör, mevzuat değişiklikleri veya etkinlik yapısındaki değişiklikler dahil olmak üzere bu Ş&K’yı ve etkinlik formatını tek taraflı olarak değiştirme hakkını saklı tutar. Değişiklikler önceden bildirilecektir.

İşbu Sözleşme’ye aykırı davranan kişiler, herhangi bir iade, cayma veya tazminat hakkı olmaksızın etkinlikten çıkarılabilir. Bilet satın alma sırasında belirtilen özel şartlar, bu metne göre öncelikli olacaktır.

YAŞ POLİTİKASI

18 yaş altı kişiler etkinliğe tek başına katılamaz; 18 yaş üstü bir yetişkin ile birlikte olmalıdır.

12 yaş altı Katılımcılar ücretsizdir ancak çocuk bileti gereklidir. 12 yaş üstü Katılımcılar tam bilet almak zorundadır.

Çocuğunuzun yarış öncesi ve sonrası gözetiminden siz sorumlu olacaksınız. Gözetimsiz bırakılması halinde organizatör sizi diskalifiye edebilecektir.

Yerel Organizatör, 18 yaş altı kişiler için herhangi bir gözetim veya bakım yükümlülüğü kabul etmeyecektir.

Bazı etkinliklerde ek yaş sınırlamaları olabilir. After party etkinlikleri, düzenlenmesi halinde, yalnızca 18+ katılımcılara açıktır.

BİLETLER, FİYATLANDIRMA VE SÖZLEŞME

Etkinliklerin katılımcı sayısı sınırlı olduğundan, popüler etkinliklerin biletleri hızla tükenebilir. Fiyatlar, coğrafi pazarlara, yer durumuna, seçilen başlangıç saat aralığına, mekanın gerekliliklerine ve/veya yönetmeliklere göre değişiklik gösterebilir; ayrıca fiyatları herhangi bir zamanda değiştirme hakkımızı saklı tutarız.

Aksi belirtilmedikçe, kayıt sayfamızda yer alan tüm fiyatlar Katma Değer Vergisi (KDV) ve/veya diğer vergiler dâhil olarak sunulmaktadır. Bilet fiyatlarına,tüm teknik ve idari süreçleri kapsayacak şekilde hizmet bedeli (“Hizmet Bedeli”) ve varsa seçilen esnek seçeneklere ilişkin bir bedel (“Esneklik Bedeli”) dâhildir. İşbu Sözleşme’de aksi kararlaştırılmadıkça, Hizmet Bedeli ve Esneklik Bedeli iade edilmez.

Ödeme yöntemleri değişiklik gösterebilir; kabul edilen ödeme yöntemleri, biletinizi satın aldığınız platformda belirtildiği şekilde olacaktır.

Vivenu, Inc. (“Vivenu”), Etkinlikler’in kayıt süreci kapsamında Yerel Organizatör adına hizmet sağlayıcı olarak faaliyet göstermektedir.

Satın alma işlemleri kredi kartı onayına tabidir ve yalnızca fatura adresi ile diğer fatura bilgileri doğrulandıktan sonra işleme alınır. Bazen, bir satın alma işlemi için yanlış fatura veya kredi kartı hesabı bilgileri alırız ve bu durum işlemin ve teslimatın gecikmesine neden olabilir. Bu durumlarda, müşteri hizmetlerimiz satın alma sırasında sağlanan bilgileri kullanarak sizinle iletişime geçmeye çalışacaktır. İlk denememizden sonra size ulaşamazsak, siparişinizi başka bir bildirimde bulunmaksızın iptal edebiliriz (bu durumda sizden herhangi bir ücret tahsil edilmeyecektir).

Ödeme bilgilerinizi girdikten sonra bir onay e-postası almamanız, ödeme sırasında bir hata mesajı ile karşılaşmanız veya hizmet kesintisi yaşamanız halinde, siparişinizin tamamlanıp tamamlanmadığını HYROX müşteri hizmetleri aracılığıyla teyit etmek sizin sorumluluğunuzdadır. Satın alma sürecinde ortaya çıkabilecek aksaklıkların yalnızca tarafınızca fark edilebileceği kabul edilir. Onay e-postası almadığınız gerekçesiyle siparişin oluşmadığını varsaymanız halinde, teknik arızalardan veya herhangi bir kayıptan (maddi veya manevi) sorumlu tutulmayacağımızı kabul edersiniz.

Satın alma işleminiz e-posta yoluyla onaylandığında, işbu Sözleşme’ye uygun olarak ve bunlara tabi olmak üzere (işbu Sözleşme’de aksi belirtilmedikçe diğer tüm şart ve koşullar hariç olmak kaydıyla) ilgili Etkinlik’e katılımınıza ilişkin olarak taraflar arasında bağlayıcı bir sözleşme kurulmuş olur.

Ödemenin herhangi bir nedenle işleme alınmaması halinde, Yerel Organizatör hiçbir sorumluluk kabul etmeksizin sözleşmeyi derhal feshetme hakkına sahiptir. Bu şekilde gerçekleştirilecek fesih ile makul ölçüde bağlantılı tüm masraflardan siz sorumlu olursunuz.

Mevcut olduğu durumlarda, tarafımızca sağlanan indirim veya ödeme kodları, ilgili şart ve koşullara tabi olmak kaydıyla kayıt sırasında ödeme aracı olarak kabul edilir. Bu kodlar kişiye özeldir ve üçüncü kişilere devredilemez, satılamaz veya temlik edilemez.

Yerel mevzuatın size sözleşme ile hariç tutulamayacak belirli iptal, geri ödeme veya cayma hakları tanıdığı bir yargı bölgesinde bulunan bir tüketiciyseniz, bu yasal haklar işbu Sözleşme’ye göre öncelikli olacaktır. Bu Sözleşme’nin belirli bir tarih veya dönemde sağlanacak bir boş zaman etkinliği hizmetiyle ilgili olduğunu ve cayma haklarının (ve “cayma sürelerinin”) belirli yargı bölgelerinde geçerli olmadığını kabul ve beyan edersiniz.

Etkinlik bilet satışlarına ilişkin ödeme işlemleri üçüncü taraf ödeme hizmet sağlayıcıları aracılığıyla gerçekleştirilmektedir. Bu sağlayıcıların MASAK ve uluslararası kara para aklamanın önlenmesine (AML) ilişkin düzenlemeler kapsamındaki uyum yükümlülükleri nedeniyle, belirli bölgelerden veya belirli kartlar ile ödeme yapılması mümkün olmayabilir. HYROX World ve Yerel Organizatör bu hususlardan dolayı herhangi bir sorumluluk kabul etmez.

BİLET KOŞULLARI, İADE VE DEĞİŞİKLİKLER

Herhangi bir satın alma işlemini tamamlamadan önce, satın alma işleminizi dikkatlice gözden geçirmeniz gerekmektedir. Çevrimiçi olarak satın alınan ve kullanılmamış biletler için 24 saatlik bir iade hakkı tanınmaktadır. 24 saatin sonunda satışlar kesinleşir ve işbu Sözleşme’de açıkça belirtilen haller dışında satın alınan biletler iade edilemez.

Bilet satın alma işleminin tamamlanmasından sonra, işbu Madde 5’de açıkça düzenlenen istisnalar saklı kalmak kaydıyla, biletler devredilemez, değiştirilemez, iade edilemez veya geri alınamaz.

Etkinlik biletleri için aşağıdaki şartlar geçerlidir:

Atlet Standart

(Non-Flex)

Herhangi bir iade, geri ödeme, devir veya değişiklik yapılmaz; buna sporcu adı, kategori, etkinlik veya seçilen yaş grubu dâhildir.

Atlet Lite Flex

Herhangi bir iade veya geri ödeme yapılmaz.

Her bir sporcu için, her bilet kapsamında ve aynı cinsiyette bir kişi ile sınırlı olmak üzere, yarıştan bir gün önce saat 07:59’a (Etkinlik saat dilimi) kadar bir (1) defaya mahsus isim değişikliği yapılabilir..

Seçilen kategori, etkinlik veya yaş grubunda herhangi bir zamanda değişiklik yapılamaz.

Dünya Şampiyonası biletleri için geçerli değildir.

Atlet Dünya Şampiyonası

Sadece davet üzerine katılım sağlanabilir.

Çiftler Kategorisinde, sporculardan birinin belgelenmiş hastalık veya yaralanma nedeniyle yarışa katılamaması halinde, aynı cinsiyet ve aynı yaş grubundan bir kişi ile sınırlı olmak üzere, bilet başına bir (1) defaya mahsus isim değişikliği yapılabilir. Bu değişiklik, geçerli bir tıbbi rapor ibraz edilmesi koşuluna bağlı olup HYROX’un tamamen kendi takdirine bağlı onayına tabidir. Yarış tarihinden 4 haftadan daha kısa süre önce yapılan geç değişikliklerde kişiselleştirilmiş ürünlerin (varsa) sağlanması mümkün olmayacaktır.

Yukarıda belirtilen durumlar haricinde, sporcu adı, kategori veya seçilen etkinlik dâhil olmak üzere herhangi bir iade, geri ödeme, devir veya değişiklik yapılmaz.

Seyirci/Diğer

Herhangi bir iade, geri ödeme veya değişiklik yapılmaz; buna seçilen etkinlik dâhildir.

Adaptif Biletlere ilişkin olarak, “adaptif” sporcular HYROX Kurallar Kitabı’nda tanımlandığı şekilde belirlenir. Bir sporcunun Adaptif Bilet satın alması ve Yerel Organizatörün tamamen kendi takdirine bağlı olarak söz konusu sporcunun adaptif tanımına uymadığını tespit etmesi halinde, Yerel Organizatör ilgili satın alma işlemini iptal etme ve bedeli iade etme hakkına sahiptir; bu durumda size karşı herhangi bir ek sorumluluk doğmaz. Satın alma işlemi öncesinde dikkatli bir değerlendirme yapmanız gerekmekte olup, emin olmadığınız durumlarda satın alma öncesinde (https://hyrox.com/contact/) adresi üzerinden bizimle iletişime geçmeniz gerekmektedir.

Bilet şartlarının izin verdiği durumlarda, isim değişiklikleri HYROX hesabınız üzerinden çevrimiçi olarak yapılmalıdır.

Bilet satın aldığınız EtkinliK2e katılım sağlamanız sizin sorumluluğunuzdadır ve herhangi bir nedenle katılım sağlayamamanız halinde tarafımızın herhangi bir sorumluluğu bulunmamaktadır. Örneğin, aynı gün iki farklı yarış için bilet satın almanız ve yarış saatlerinin çakışması nedeniyle her iki yarışa da katılamamanız durumunda tarafımız sorumlu tutulamaz.

BİLETLERİN YASADIŞI SATIŞI

Etkinlik biletlerinin veya promosyon kodlarının hukuka aykırı şekilde satılması (veya satışa teşebbüs edilmesi), sahteciliği veya kopyalanması; herhangi bir tazminat yükümlülüğü doğmaksızın el konulması ve iptal edilmesi için haklı sebep teşkil eder. Yürürlükteki tüm bilet satış mevzuatına uyum sağlamak sizin sorumluluğunuzdadır. Promosyon kodları veya geçiş kartları, tarafımızca önceden verilmiş yazılı izin bulunmadıkça reklam, promosyon, yarışma veya çekiliş amaçlarıyla kullanılamaz.

ÜÇÜNCÜ TARAF ÜRÜNLERİ

Etkinlik Fotoğrafçılığı (Sportograf)

Etkinlik fotoğrafçılığı hizmetleri, kayıtlı adresi Süsterfeldstrasse 170, 52072 Aachen, Almanya olan Sportograf Digital Solutions GmbH (“Sportograf”) tarafından sağlanmaktadır. Sportograf ürünlerini satın almayı tercih etmeniz halinde, işbu Sözleşme’ye ek olarak https://www.sportograf.com/en/agb adresinde yer alan Sportograf’a ait şart ve koşullara tabi olmayı ve kişisel verilerinizin Sportograf’ın gizlilik politikasına uygun olarak işlenmesini kabul edersiniz.

Yerel Organizatör’ün, Sportograf ürünlerinin satışı bakımından aracılık faaliyeti yürüttüğünü kabul edersiniz. Yürürlükteki mevzuatın izin verdiği azami ölçüde, Yerel Organizatör, Sportograf ürünlerinden kaynaklanan herhangi bir ayıp, gecikme veya sair aksaklıktan dolayı hiçbir sorumluluk kabul etmez. Sportograf ürünlerine ilişkin her türlü talep, şikâyet veya uyuşmazlık doğrudan Sportograf’a yöneltilmelidir.

ETKİNLİK KAYDI VE KATILIM

Yerel Organizatör, aşağıdaki hallerde herhangi bir zamanda ve herhangi bir geri ödeme yükümlülüğü olmaksızın sizi Etkinliğe katılmaktan ve/veya Etkinlik alanına girişten diskalifiye etme ve/veya hariç tutma hakkını saklı tutar:

Etkinlikten önce biletinizi kişiselleştirmemiş olmanız;

Geçerli bir bilete sahip olmamanız;

Tarafımıza yanlış veya yanıltıcı bilgi vermeniz ya da kimlik ve/veya yaş doğrulamasına ilişkin belge sunmamanız;

Genel sağlık durumunuzun uygun olmadığına dair makul şüphe bulunması veya herhangi bir hastalık belirtisi göstermeniz (nefes darlığı, öksürük veya ateş dâhil ancak bunlarla sınırlı olmamak üzere);

Etkinlik sırasında herhangi bir yasadışı maddeyi (performans artırıcılar dâhil olmak üzere) bulundurmanız veya bunların etkisi altında olduğunuz yönünde makul şüphe bulunması; veya

Yerel Organizatör’ün veya Etkinlik alanı sahibinin kanaatine göre, fiil ve/veya yerine getirmediğiniz yükümlülükleriniz (Etkinlik öncesinde, sırasında veya sonrasında) Etkinlik’in veya Katılımcılar’ın güvenliğini tehlikeye atması ya da herhangi bir Etkinlik kuralını ihlal etmesi.

“Etkinlik Kuralları”; Yerel Organizatör ve/veya Etkinlik alanı sahibi (“Mekân Sahibi”) tarafından bildirilen veya erişilebilir kılınan tüm yürürlükteki mevzuat, ilan edilen kurallar ve uyarılar, güvenlik duyuruları, etkinlik ve mekân politikaları ile düzenlemeleri (HYROX Etkinlik Davranış Kuralları dâhil ancak bunlarla sınırlı olmamak üzere) ifade eder.

Etkinlik süresince her zaman genel ahlak ve iyiniyet kurallarına uymanız, Etkinlik Kurallarına riayet etmeniz ve Etkinlik’e güvenli şekilde katılım veya girişe ilişkin olarak Etkinlik yetkililerince alınacak kararlara uymanız gerektiğini kabul edersiniz. Bu yükümlülük, genel olarak diğer kişilere, ekipmanlara, tesislere ve mülklere saygılı davranmayı da kapsar.

Erişim kontrolü amacıyla, belirli Etkinlikler’de Katılımcılar’a RFID çipi içeren elektronik bileklikler sağlanabilir. RFID çipi, Katılımcı’nın Etkinlik’e giriş yetkisini doğrulayan dijital bilgilerin yanı sıra nakitsiz ödeme işlevselliğini de içerebilir. RFID bilekliğinin kullanımına ilişkin hüküm ve koşullar Ek’te düzenlenmiştir.

Etkinlik alanında yalnızca kişisel ve özel kullanım amacıyla fotoğraf, ses ve video kaydı yapabilirsiniz. Bu içerikleri, Etkinlik’i, Katılımcılar’ı, HYROX’u veya iş ortaklarını yanlış yansıtacak, zarar verecek veya olumsuz etkileyecek şekilde yayınlayamaz, paylaşamaz, dağıtamaz, satamaz, lisanslayamaz veya ticari amaçla kullanamazsınız. HYROX, bu şartların ihlali halinde ilgili içeriklerin kaldırılmasını talep etme hakkına sahiptir ve bu taleplere derhal uyacağınızı kabul edersiniz.

Etkinlik ile bağlantılı olarak ve/veya HYROX sponsor ortağı sıfatıyla, kendi işiniz veya Yerel Organizatör ya da HYROX World ile sözleşmesel ilişkisi bulunmayan herhangi bir üçüncü kişinin işi ile ilgili olarak hiçbir ticari faaliyeti planlamayacak, organize etmeyecek, yürütmeyecek, tanıtmayacak veya desteklemeyeceğinizi kabul edersiniz.

Atlet Koşulları

Etkinlik’e katılım sağlayarak, katılımınızın HYROX Kurallar Kitabı’na tabi olduğunu ve bu kurallara bağlı bulunduğunuzu kabul edersiniz.

İşbu Sözleşme 9.1. madde kapsamındaki haklara ek olarak, Yerel Organizatör aşağıdaki hallerde herhangi bir zamanda ve herhangi bir iade veyahut tazmin yükümlülüğü olmaksızın sizi diskalifiye etme ve/veya Etkinlik’e katılımınızı engelleme hakkını saklı tutar:

Kayıt sırasında yanlış kişisel bilgi vermeniz (cinsiyetiniz ve uyruğunuz dâhil olmak üzere);

Biletinize tahsis edilmiş QR kodu/barkod ve/veya resmi start numarasının bulunmaması;

Kayıt yaptırdığınız yarış için katılım şartlarını karşılamamanız;

Elite 15 sporcuları bakımından, HYROX World tarafından ilgili sezon için düzenlenen geçerli Sporcu Lisansının bulunmaması veya ibraz edilememesi,

Uygulanabilir olması halinde, başka bir spor otoritesi veya anti-doping kuruluşu tarafından yaptırıma maruz kalmış olmanız.

Başlangıç belgelerinizi teslim aldığınızda eksiksiz olup olmadığını kontrol etmekle yükümlüsünüz. Başlangıç belgeleri içerisinde yer alan zamanlama çipi, bitiş çizgisini geçmenizin ardından derhal bitiş alanındaki Etkinlik personeline iade edilmelidir. Zamanlama çipinin kaybolması veya hasar görmesi halinde, Yerel Organizatör yerel para birimi karşılığı 100 ABD Doları tutarındaki bedeli sizden talep etme hakkını saklı tutar.

Yarış saatiniz ve başlangıç grubunuz Etkinlik öncesinde tarafınıza bildirilecektir. Yarış saatinizi veya başlangıç grubunuzu kaçırmanız halinde yarışmaya katılım hakkınız bulunmaz.

Yürürlükteki HYROX Kurallar Kitabı uyarınca, resmi sıralamaların Olimpik kurallara paralel olarak sporcuların doğumda kayıtlı biyolojik cinsiyetine göre belirlendiğini kabul edersiniz. Doğumda kayıtlı cinsiyetinden farklı bir kategori altında kayıt yaptırmak isteyen kişiler rekreatif olarak yarışmaya katılabilir, ancak resmi sıralamalara dâhil edilmez.

Riskin Kabulü ve Tıbbi Müdahale

Etkinliğe katılım tamamen kendi sorumluluğunuzdadır ve iyi bir sağlık durumuna ve yeterli fiziksel kondisyona sahip olmanızı gerektirir. Katılım öncesinde sağlık durumunuzu değerlendirmek sizin sorumluluğunuzdadır. Kayıt, akreditasyon ve katılım ile birlikte, Etkinliğe özgü risklerin farkında olduğunuzu ve katılımınıza engel teşkil edecek herhangi bir sağlık sorununuz bulunmadığını beyan etmiş olursunuz. Yerel Organizatör, herhangi bir zamanda sağlık durumunuzu tevsik edici belge talep etme hakkına sahiptir; bu kapsamda talep edilmesi halinde, sağlık durumunuza ilişkin tıbbi bir rapor veya benzeri nitelikte belge sunmayı kabul edersiniz.

Etkinlik’e katılmak amacıyla işbu Sözleşme’yi imzalayarak şağıdaki hususları kabul ve beyan edersiniz: (i) Etkinliğe katılım için kayıt tarihiniz ile Etkinlik tarihi arasında sağlık durumunuzda değişiklik meydana gelebileceğini (hastalık, yaralanma, enfeksiyon veya hamilelik dâhil ancak bunlarla sınırlı olmamak üzere) ve (ii) bu riski tamamen kendi sorumluluğunuzda üstlendiğinizi; sağlık durumunuzdaki değişiklik nedeniyle Etkinliğe katılamamanız halinde herhangi bir iade hakkınız bulunmadığını.

Tıbbi hususlara ilişkin olarak:

Etkinlik sırasında veya sonrasında hastalanmanız ve/veya tıbbi müdahale almanız halinde, Yerel Organizatör, yetkilendirilmiş sağlık hizmeti sağlayıcıları, doktorlar veya hastanelerin, tedavi ve müdahaleye ilişkin bilgileri Yerel Organizatör veya yetkilendirdiği kişilerle paylaşmasına izin verdiğinizi;

Etkinlik sırasında hastalık, yaralanma veya acil bir durum meydana gelmesi halinde, Yerel Organizatör, çalışanları, yüklenicileri veya yetkili personel tarafından gerekli görülen tıbbi müdahalenin (anestezi uygulanması dâhil olmak üzere) yapılmasına açık rıza verdiğinizi kabul edersiniz.

GÜVENLİK VE EMNİYET

Etkinlik alanına giriş sırasında ve/veya Etkinlik süresince siz ve eşyalarınız güvenlik kontrolüne ve aramaya tabi tutulabilirsiniz. Bu tür aramalara rıza gösterdiğinizi ve bu kapsamda ileri sürebileceğiniz her türlü talep ve haktan feragat ettiğinizi kabul edersiniz. Güvenlik kontrolüne rıza göstermemeniz halinde, herhangi bir geri ödeme veya tazminat yükümlülüğü doğmaksızın Etkinlik’e girişiniz reddedilebilir veya Etkinlik alanından çıkarılabilirsiniz. Alkol, uyuşturucu ve diğer kontrol altındaki maddeler ile ateşli silahlar ve bıçaklar dâhil ancak bunlarla sınırlı olmamak üzere belirli eşyaların Etkinlik alanına sokulması yasaktır.

Etkinlik süresince kişisel eşyalarınızın korunmasından ve muhafazasından bizzat sorumlu olduğunuzu kabul edersiniz. Yürürlükteki mevzuatın izin verdiği azami ölçüde, Etkinlikte kaybolan, hasar gören veya çalınan kişisel eşya ve/veya mallardan Yerel Organizatör ve Mekân Sahibi sorumlu tutulamaz.

Rehber köpekler hariç olmak üzere, Etkinlik alanına hayvan getirilmesi veya hayvan bulundurulması yasaktır.

MÜCBİR SEBEP, ETKİNLİKLERİN ERTELENMESİ VE İPTALİ

Yerel Organizatör, Etkinlikleri düzenleme yükümlülüğü altında değildir. İşbu 10. maddenin diğer hükümlerine tabi olmak kaydıyla, aşağıda sayılanlar dahil ancak bunlarla sınırlı olmamak üzere herhangi bir sebeple Etkinlikleri tamamen veya kısmen erteleme, iptal etme veya Etkinliğin zamanını ve/veya yerini değiştirme hakkını saklı tutar:

Şiddetli hava koşulları, doğal afetler (sel, kasırga, deprem veya yangın dâhil), salgın hastalıklar, pandemiler, küresel sağlık krizleri, savaş, terör, iç karışıklıklar, işçi-işveren uyuşmazlıkları, grevler, hükümet tedbirleri, ambargolar, elektrik kesintileri, ekonomik imkânsızlıklar ve düşük katılım sayıları dâhil olmak üzere Yerel Organizatörün makul kontrolü dışında kalan haller;

Herhangi bir güvenlik birimi, kolluk kuvveti, sağlık otoritesi ve/veya yerel idarenin tavsiye, onay veya izinleri (ya da bu izinlerin geri çekilmesi) veya Katılımcıların güvenliğini ve emniyetini ya da Etkinliğin icrasını etkileyen diğer tüm nedenler; veya

İlgili hükümet, mahkeme, yetkili ulusal otorite veya idari kurumlar tarafından yürürlükteki mevzuat, düzenleme, karar veya uygulamalarda meydana gelen değişiklikler,

(“Mücbir Sebep Olayı”).

Kayıt yaptırdığınız herhangi bir Etkinlik’in Mücbir Sebep Olayı veya başka herhangi bir sebeple iptal edilmesi veya ertelenmesi halinde, aynı Etkinlik’in bir sonraki yıl düzenlenecek edisyonuna ücretsiz olarak yeniden kayıt yaptırma hakkına sahip olursunuz. Etkinlik’e katılamamanız halinde, 30 gün içinde yazılı bildirimde bulunmanız kaydıyla, aynı veya bir sonraki sezon içerisinde ve uygunluk durumuna bağlı olarak, bulunduğunuz bölgede düzenlenecek alternatif bir Etkinlik’e ücretsiz olarak yeniden kayıt hakkı talep edebilirsiniz.

Kayıt yaptırdığınız Etkinlik kapsamındaki yarışın herhangi bir sebeple iptal edilmesi halinde, Yerel Organizatör, kendi makul takdirine bağlı olarak söz konusu yarışı aynı gün veya Etkinlik kapsamında farklı bir günde yeniden düzenleyebilir. Bu durumda tamamlanamayan yarışa ilişkin sıralamalar veya dereceler geçersiz sayılır ve dikkate alınmaz.

Hiçbir koşulda, iptal edilen veya ertelenen bir Etkinlik ya da herhangi bir erteleme ile bağlantılı olarak seyahat, konaklama veya benzeri masraflarınızdan Yerel Organizatör sorumlu tutulamaz.

Yerel Organizatör, Etkinlik’in başlangıç saatini değiştirme hakkını saklı tutar. Başlangıç saatinde değişiklik yapılması halinde, mümkün olan en kısa sürede revize edilmiş saat tarafınıza bildirilecektir. Etkinlik’in ilan edilen tarihte gerçekleştirilmesi kaydıyla, başlangıç saatindeki değişiklikler nedeniyle herhangi bir iade veya tazminat talep edilemez.

Yerel Organizatör, kendi takdirine bağlı olarak Etkinlik formatını, parkur ve/veya mesafe dahil olmak üzere değiştirme hakkını saklı tutar. Bu tür değişiklikler halinde herhangi bir iade veya tazminat hakkı doğmaz ve bu değişikliklerden kaynaklanan başka herhangi bir sorumluluk kabul edilmez.

RİSKİN KABULÜ, FERAGAT VE SORUMLULUĞUN SINIRLANDIRILMASI

İşbu Sözleşme’nin imzası ile spor etkinliği dahil olmak üzere herhangi bir etkinliğe katılmanın doğasında belirli riskler olduğunu anladığınız ve kabul ettiğinizi; Etkinlik’e katılımınızla (örneğin, mekana girerek ve/veya Etkinlik’e katılarak) bağlantılı olarak ortaya çıkan, sınırlama olmaksızın, seyirci alanına, mekanın tribünlerine, koridorlar ve/veya yiyecek-içecek alanlarına atılan veya uçan nesneler veya parçalar, etkinlikteki özel efektler, diğer seyircilerin eylemleri veya yükümlülüklerini yerine getirmemesii ve bunlardan kaynaklanan herhangi bir hastalıkla ilgili riskler dahil olmak üzere, Etkinlik’e katılımınızla bağlantılı olarak ortaya çıkan tüm mal kaybı veya ziyanıı, kişisel yaralanma, hastalık ve/veya ölüm risklerini hür iradenizle üstlendiğinizi; işbu risklerin tamamen ortadan kaldırılamayacağını anladığınızı beyan ve taahhüt edersiniz.

İşbu Sözleşme’nin imzasıyla Etkinlik öncesinde, sırasında veya sonrasında meydana gelip gelmemesine bakılmaksızın, Etkinlik’den kaynaklanan, Etkinlik ile ilintili olan veya Etkinlik’e bağlı olarak ortaya çıkan, mal kaybı, hastalık (havadan bulaşan veya başka türlü hastalıklar dahil olmak üzere, bulaşıcı herhangi bir hastalığa veya bakteriye, virüse ya da bulaşıcı bir hastalığa yol açabilecek diğer patojenlere maruz kalma riskleri dahil), yaralanma ve/veya herhangi bir nedenden kaynaklanan ölüm gibi bilinen ve olası tüm risk ve tehlikeleri gönüllü olarak üstlendiğinizi kabul, beyan ve taahhüt edersiniz. Sorumluluktan Ari Tutulan Taraflar'ın (aşağıda tanımlanmıştır), veya herhangi bir üçüncü kişinin ihmalinden veya farklı bir fiilden kaynaklansın ya da kaynaklanmasın, Etkinlik öncesinde, sırasında veya sonrasında meydana gelen herhangi bir talep, kayıp, hasar veya yaralanmadan sorumlu veya yükümlü olmayacağını kabuli beyan ve taahhüt edersiniz.

Yürürlükteki mevzuatın izin verdiği en geniş ölçüde, Etkinlik’e katılımınızdan kaynaklanan veya katılımıza atfedilebilen yaralanma, sakatlık, ölüm veya mal hasarı nedeniyle, Yerel Organizatör, HYROX World ve bunların ilgili yetkilileri, yöneticileri, müdürleri, çalışanları, temsilcileri, bağlı kuruluşları, hissedarları/üyeleri, halefleri ve devralanlarına karşı, dünyanın herhangi bir yargı alanında şu anda bilinen veya bundan sonra bilinecek olan tüm taleplerden açıkça feragat eder ve bunları ibra edersiniz (topluca, “Sorumluluktan Ari Tutulanlar”), Yerel Organizatör’ün veya herhangi bir Sorumluluktan Ari Tutulan’ın ihmalinden veya başka bir nedenden kaynaklansın ya da kaynaklanmasın, Etkinliğe katılımınızdan kaynaklanan veya buna atfedilebilen yaralanma, sakatlık, ölüm veya mal hasarı nedeniyle. Yerel Organizatöre veya başka herhangi bir Sorumluluktan Ari Tutulan kişiye karşı bu tür bir talepte bulunmayacağınızı taahhüt edersiniz ve Yerel Organizatör’ü ve diğer tüm Sorumluluktan Ari Tutulanlar’ı bu tür taleplerden doğan sorumluluktan sonsuza kadar ari tutacağınızı kabul, beyan ve taahhüt edersiniz.

Yasaların izin verdiği azami ölçüde, biz (bağlı kuruluşlarımız, ana şirketlerimiz, iştiraklerimiz ve bunların ilgili yetkilileri, yöneticileri, çalışanları, acenteleri, yasal temsilcileri ve alt yüklenicileri dahil) ve ortaklarımız, herhangi bir kişiye (siz dahil) veya mülke, nedeni ne olursa olsun, herhangi bir kayıp, yaralanma veya hasardan sorumlu olmayacağız:

Sözleşme ihlali veya bizim ya da iş ortaklarımızın gerekli özen yükümlülüğünün ihlali söz konusu olmayan her türlü durumda; ve

Bu tür kayıp veya zararın söz konusu ihlalin doğrudan bir sonucu olmadığı durumlarda (bizim ya da bir iş ortağımızın ihmalinden kaynaklanan ölüm veya bedensel yaralanma hariç).

Aşağıdaki 11.6. maddeye tabi olmak kaydıyla, aşağıdakileri kabul edersiniz:

Yerel Organizatör, bu Sözleşme veya bir Etkinlik kapsamında ya da bunlarla bağlantılı olarak, hiçbir nedenle size karşı aşağıdakilerden sorumlu olmayacaktır: (i) kar kaybı; (ii) itibar kaybı; (iii) veri kaybı; (iv) iş, gelir veya şerefiye kaybı; (v) beklenen tasarruf kaybı; (vi) sizin adınıza veya sizin tarafınızdan bir hayır kurumuna yapılan bağış taahhütleri; (vii) iptal edilen veya ertelenen herhangi bir Etkinlikle ilgili olarak ortaya çıkan seyahat, konaklama veya diğer masraflarınız; (viii) diğer her türlü dolaylı veya sonuçsal kayıp veya hasar; her durumda, söz konusu kayıp veya hasarın makul olarak öngörülebilir olup olmadığına veya tarafların öngörüsünde olup olmadığına bakılmaksızın; ve

Yerel Organizatör’ün size karşı, herhangi bir sebep veya nedenden ötürü üstleneceği azami sorumluluk, Yerel Organizatör’ün sizden aldığı toplam tutarı aşmayacaktır.

Bu Sözleşme’deki hiçbir hüküm, Yerel Organizatör’ün aşağıdakilerle ilgili sorumluluğunu sınırlandıran veya hariç tutan bir şekilde yorumlanamaz: (i) ihmalden kaynaklanan ölüm veya bedensel yaralanma; (ii) dolandırıcılık veya hileli beyan; veya (iii) sorumluluğun sınırlandırılmasının, hariç tutulmasının veya hariç tutulmaya çalışılmasının yasa dışı veya hukuka aykırı olacağı diğer her türlü durum. Tüketici olarak yasal haklarınız bu Sözleşme’den etkilenmez.

Yerel Organizatör, Etkinlikte sunulan yiyecek ve içeceklerde bulunan alerjenler konusunda hiçbir sorumluluk kabul etmez.

GİZLİLİK VE VERİ KORUMA

Kişisel verileriniz, web sitemizde yer alan gizlilik politikasına uygun olarak işlenmekte ve iş ortaklarımız ile paylaşılmaktadır.

Önceden açık rızanızın bulunması kaydıyla, HYROX World ve bağlı şirketleri, iş ortakları ve/veya üçüncü taraflar, HYROX’a veya söz konusu üçüncü taraflara ait ürün, hizmet ve etkinliklere ilişkin bilgilendirme, bülten ve benzeri ticari elektronik iletileri tarafınıza iletebilir. Bu iletiler, iletişim tercihlerinize uygun olarak gönderilecek olup, dilediğiniz zaman bu iletilere ilişkin aboneliğinizi sonlandırma hakkına sahipsiniz.

KAYIT, YAYIN VE YAYIM

Etkinlik’in halka açık bir etkinlik olduğunu, Etkinlik’in düzenlendiği mekanın içinde ve dışında sergilediğiniz görünüm ve davranışlarınızın kamusal nitelikte olduğunu ve Etkinlik sırasındaki eylemleriniz veya davranışlarınızla ilgili olarak herhangi bir gizlilik beklentiniz olmadığını kabul beyan ve taahhüt edersiniz.

İşbu Sözleşme ile (i) Yerel Organizatör, HYROX World, grup şirketleri, ortakları ve bağlı kuruluşları (“HYROX Tarafları”), (ii) HYROX Tarafları tarafından yetkilendirilmiş veya onlar adına hareket eden tüm taraflar ve (iii) akredite medya mensuplarına, Etkinlik’e katılımınızı filme alma, görüntüleme ve kaydetme izni vermiş olursunuz. Bu izin, herhangi bir medya formatında adınızı, görüntünüzü, tanınabilir görsel kimliğinizi, sesinizi, yazılı beyanınızı, fotoğrafınızı ve/veya diğer biyografik bilgilerinizi fotoğraflamak, filme almak, kaydetmek ve/veya başka bir şekilde yakalamak hakkını içerir.

Etkinlik sırasında HYROX Tarafları tarafından veya adına çekilen tüm fotoğraf, video, film, sinema filmi, kayıt ve içeriklerin münhasır mülkiyetinde olacağını kabul ve beyan edersiniz. Adınız, görüntünüz, tanınabilir görsel kimliğiniz, sesiniz, yazılı beyanınız, fotoğrafınız ve/veya diğer biyografik bilgileri içeren bu tür fotoğraf, sinema filmi, kayıt ve içeriklerin, HYROX Tarafları tarafından, önceden bildirim, onay veya tazminat olmaksızın, tüm dünyada, tüm medya ve formatlarda, tamamen veya kısmen, HYROX ürün ve hizmetlerinin ve HYROX Tarafları tarafından düzenlenen etkinliklerin tanıtımı, reklamı ve pazarlaması dahil ancak bunlarla sınırlı olmamak üzere, herhangi bir meşru ticari veya ticari olmayan amaçla, önceden bildirimde bulunmaksızın, onay almaksızın veya tazminat ödemeksizin kullanılabileceğini kabul ve beyan edersiniz.

Görüntünüzün materyallerimizde kullanılmasıyla ilgili endişeleriniz varsa, lütfen HYROX Müşteri Hizmetleri ile iletişime geçin veya Etkinlik gününde Kayıt Masasını ziyaret edin. Talebinizi karşılamak için makul çabayı göstereceğiz, ancak tüm grup veya arka plan görüntülerinden tamamen çıkarılacağını garanti edemeyiz.

HYROX FİKRİ MÜLKİYET HAKLARI

HYROX World, “HYROX” ticari markasının ve HYROX ile ilgili tüm fikri mülkiyet haklarının tek sahibidir – World Series of Fitness Racing, bunlarla sınırlı olmamak üzere, HYROX World tarafından oluşturulan marka logoları, kılavuzlar, belgeler ile Etkinlikte veya yetkili herhangi bir üçüncü tarafça üretilen görseller, görsel-işitsel kayıtlar (ör. önemli anlar, klipler, alıntılar) dahil olmak üzere (topluca “HYROX IP”).

HYROX World'ün açık yazılı onayı olmadan HYROX IP'yi kullanmanıza izin verilmez.

Bu Sözleşme’deki hiçbir hüküm, size HYROX ile bir ortaklık, sponsorluk, destek veya bağlılık ima eden herhangi bir şekilde HYROX adını veya logosunu kullanma veya çoğaltma hakkı vermez.

GENEL HÜKÜMLER

İşbu Sözleşme eklerinde, geçerli olabilecek ek şartlar belirtilmiştir.

Bu Sözleşme İngilizce dilinde hazırlanmıştır ve başka dillere çevrilebilir. İngilizce metin ile herhangi bir çeviri metni arasında çelişki olması durumunda, İngilizce metin geçerli olacaktır.

Aramızdaki sözleşme, taraflar arasındaki anlaşmanın tamamını oluşturur ve hiçbir taraf, bu Sözleşme’de halihazırda belirtilmeyen, sözleşmemizle ilgili olarak diğer tarafça veya diğer taraf adına yapılan herhangi bir beyan, teminat, garanti veya taahhütle ilgili olarak herhangi bir hak talebinde bulunamaz veya hukuki yola başvuramaz.

Bu Sözleşme’nin herhangi bir şartı, koşulu veya diğer hükmü, yetkili bir mahkeme tarafından geçersiz, yasadışı veya herhangi bir hukuk kuralı veya kamu düzeni gereği uygulanamaz olarak değerlendirilirse, bu Şartlar ve Koşullardan çıkarılmış sayılır; ancak bu Şartlar ve Koşulların diğer tüm şartları, koşulları ve hükümleri yine de tam olarak yürürlükte kalır.

İşbu Sözleşme’de yer alan hiçbir hüküm, Etkinliğin gerçekleştiği ülkede yürürlükte bulunan tüketicinin korunması mevzuatı kapsamında tüketicinin sahip olduğu ve kanunen hariç tutulması veya sınırlandırılması mümkün olmayan hakları ortadan kaldırmaz veya sınırlandırmaz.

UYGULANACAK HUKUK

Bu Sözleşme ile bunlardan kaynaklanan veya bunlarla bağlantılı her türlü ihtilaf veya talep (sözleşme dışı ihtilaflar veya talepler dahil), Türkiye Cumhuriyeti kanunlarına tabi olacak ve bu kanunlara göre yorumlanacaktır.

6502 sayılı Tüketicinin Korunması Hakkında Kanun ve ilgili mevzuat uyarınca Tüketici Hakem Heyetleri ve Tüketici Mahkemelerine başvurabilirsiniz; ayrıca, Sözleşme uyarınca, Sözleşme’den kaynaklanan veya bunlarla bağlantılı her türlü ihtilaf veya iddianın çözümünde İstanbul (Çağlayan) mahkemeleri ve icra daireleri münhasır yargı yetkisine sahiptir.

RFID BİLEZİK ŞARTLARI

GENEL BİLGİLER

Etkinlik kapsamında, giriş ve erişim kontrolü, mal ve hizmetler için nakitsiz ödeme seçeneği sunmak amacıyla; RFID çipi bulunan bileklikler alabilirsiniz (bundan sonra “RFID çipi” olarak anılacaktır) ve bu şartlar, aldıysanız RFID çipi için geçerli olacaktır.

Her bir RFID çipi yalnızca belirli bir Etkinlik için verilir. Bu çip, söz konusu Etkinlik dışında erişim izni veya ödeme amacıyla kullanılamaz. Özellikle, tarafımızca düzenlenen diğer Etkinlikler’de kullanılamaz.

ORTAKLARIMIZ

RFID çiplerini kullanabilmeniz için, merkezi Am Ausferngenufer 8, 5400 Hallein, Avusturya adresinde bulunan hizmet sağlayıcı Global Event Technologies GmbH (bundan böyle “GET” olarak anılacaktır) ile işbirliği yapmaktayız. GET özellikle aşağıdaki görevleri yerine getirmektedir:

Tarafımızca gerçekleştirilen giriş ve erişim kontrolü için donanım temini;

Katılımcılar’ın örneğin kontör yükleyebilecekleri ve işlemlerini görüntüleyebilecekleri çevrimiçi platformun sağlanması (bundan sonra “Etkinlik Portalı” olarak anılacaktır)

Ayrıca, kontör yükleme, ödeme ve iade işlemlerini gerçekleştirmek üzere, kayıtlı adresi Simon Carmiggeltstraat 6-50, 1011 DJ, Amsterdam, Hollanda olan lisanslı ödeme hizmeti sağlayıcısı Adyen N.V. ile işbirliği yapmaktayız. GET, Adyen N.V. adına teknik hizmet sağlayıcısı olarak hareket etmektedir.

RFID çiplerinin verilmesi ve kullanımı, Etkinlik Portalı'nın kullanımı ve RFID çipinde depolanan kredinin yönetimi ve ödenmesi ile ilgili Katılımcıların sözleşme ilişkileri ve talepleri, münhasıran bizimle ve bize karşı kurulacak ve belirlenecektir.

RFID ÇİPLERİNİN DAĞITIMI VE GENEL KULLANIMI

Katılımcılara, etkinlik alanına vardıklarında RFID çipleri dağıtılacaktır.

RFID çipleri, talimatlarımıza uygun şekilde takılmalı ve sağlam bir şekilde sabitlenmelidir. RFID çipini takarken herhangi bir zorluk yaşarsanız, lütfen dağıtım noktasındaki personelden yardım isteyin.

Katılımcılar, Etkinlik bitene kadar RFID çiplerini güvenli bir şekilde saklamalı, özenle kullanmalı ve hırsızlık, kayıp ve kötüye kullanımdan korumalıdır. RFID çipi hassas elektronik parçalar içerir ve veri kaybını veya RFID çipinin arızalanmasını önlemek için dış manyetik alanlara maruz bırakılmamalıdır. RFID çipi değiştirilmemeli veya açılmamalıdır. RFID çipinde depolanan verilerin bağımsız olarak okunması veya değiştirilmesi yasaktır.

Etkinliğin sona ermesinden sonra, RFID çipi ilgili Katılımcılar’da kalabilir ve RFID çipini iade etme zorunluluğu yoktur.

RFID çipinin kaybolması, çalınması, kötüye kullanılması veya diğer yetkisiz kullanımlarından, söz konusu durumda kusurlu olmamamız kaydıyla, sorumlu değiliz.

RFID çipinin çalınması, kaybolması veya kötüye kullanılması ile arıza veya kusurlar, farkına varılır varılmaz derhal kart verme noktasındaki personele bildirilmelidir. Gerekirse, kart verme noktasındaki personel ilgili RFID çipini devre dışı bırakacak ve ücretsiz olarak yeni bir RFID çipi verecektir. İlgili RFID çipinde bulunan bakiye, yeni RFID çipine aktarılabilir veya iade edilebilir. Bu amaçla, kartın verildiği noktadaki personel, etkilenen Katılımcıların kimliğini doğrulayacaktır. Bu doğrulama için genellikle RFID çipinin arkasındaki RFID çip numarası ve bir kimlik belgesinin ibrazı gerekecektir. RFID çipinin veya RFID çip numarasının çalınması, kaybolması veya hasar görmesi durumunda, RFID çip numarası sağlanmadan bir aktarım veya iadeyi gerçekleştirmekle yükümlü değiliz. Ancak, diğer kimlik özelliklerine dayanarak bir iadeyi mümkün kılmak için makul çabayı göstereceğiz.

RFID çipinin güvenliği ile ilgili bunu haklı kılan objektif nedenler varsa veya RFID çipinin yetkisiz veya hileli kullanımından şüpheleniliyorsa, RFID çipini devre dışı bırakabiliriz. RFID çipinin devre dışı bırakılmasından etkilenen Katılımcıları, biletlerinin kişiselleştirilmesi sürecinde ilgili Katılımcılar tarafından sağlanan e-posta adresi aracılığıyla derhal bilgilendireceğiz. Gerekirse ve gerekli olduğu ölçüde, bilet satış noktasındaki personel (gerekirse ilgili Katılımcıların kimliğini doğruladıktan sonra) ücretsiz olarak yeni bir RFID çipi verecek ve depolanmış bakiyeyi aktaracaktır.

GİRİŞ VE ERİŞİM KONTROLÜ

Katılımcılar, Etkinlik alanına vardıklarında bir RFID çipi alacaklardır. RFID çipi, sahibinin Etkinlik’e katılma veya Etkinlik alanına giriş yapma yetkisini doğrulayan dijital bilgileri içerir.

RFID çipi, Katılımcıların Etkinlik süresince katılım veya erişim hakkının kanıtı niteliğindedir. Katılımcılar, RFID çipini belirlenen erişim noktalarında okutarak giriş yetkilerini ispat edebilirler.

RFID çipinde yer alan katılım ve erişim yetkisine ilişkin bilgiler ilgili Katılımcıya özeldir. Bu nedenle RFID çipi, başka kişilere Etkinliğe giriş hakkı sağlamak amacıyla kullanılamaz.

KREDİ YÜKLEME VE İADE

RFID çipi, Katılımcılar tarafından Etkinlik kapsamında nakitsiz ödeme yapmak amacıyla kullanılabilir.

Bu amaçla RFID çipi, Etkinlik Portalı üzerinden çevrimiçi olarak veya yerinde bulunan yükleme noktalarından (bundan sonra “Yükleme Noktaları” olarak anılacaktır) kredi ile yüklenebilir. Yükleme işlemi için kullanılabilecek ödeme yöntemleri (örn. banka ve kredi kartları, PayPal vb.), Etkinlik Portalı’nda ve Yükleme Noktalarında sunulan bilgilendirmelerde belirtilmiştir. RFID çipi ile yapılan ödeme işlemleri ve kredi bakiyesine ilişkin bilgilere de Etkinlik Portalı üzerinden erişilebilir. Bunun için Katılımcıların RFID çipine bağlı bir hesap oluşturması gerekmektedir.

RFID çipi yalnızca Bölge para birimi cinsinden yükleme yapılmasına izin verir.

RFID çipi üzerinde saklanan kredi, belirli bir Katılımcıya tahsis edilmiştir ve başka kişilere devredilemez.

Asgari yükleme tutarı 10,00 €’dur. Azami yükleme tutarı (birden fazla yükleme yapılsa dahi) her bir RFID çipi için aylık 250,00 € ile sınırlıdır

Kredi bakiyeleri üzerinden faiz ödenmez.

Katılımcılar, ilgili RFID çipinde kendi yükledikleri tutardan daha yüksek bir kredi bakiyesi bulunduğunu fark etmeleri halinde, durumu derhal bize bildirmekle yükümlüdür. Bu fazla tutarlar mal veya hizmet satın alımında kullanılamaz. Aksi halde Katılımcı, ilgili tutarları (harcanmış olsa dahi) iade etmekle yükümlüdür.

MAL VE HİZMETLERİN NAKİTSİZ ÖDEMESİ

Biz ve çeşitli diğer sağlayıcılar (hem biz hem de bu işlev kapsamında diğer sağlayıcılar bundan sonra “Sağlayıcılar” olarak anılacaktır), Etkinlik kapsamında Katılımcılara bağımsız olarak mal ve hizmet sunmaktayız.

Mal ve hizmetler, ilgili Sağlayıcı tarafından kendi adına ve kendi hesabına sunulur ve satılır. Katılımcıların bu tür mal ve hizmetlerin satın alınmasına ilişkin tek sözleşme tarafı ilgili Sağlayıcıdır. Satış standında, tekliflerde veya faturalarda açıkça satıcı olarak belirtilmediğimiz sürece, diğer Sağlayıcıların satışlarına dahil değiliz. Satın alınan mal veya hizmetlere ilişkin soru veya şikayetleriniz için doğrudan ilgili Sağlayıcı ile iletişime geçilmelidir.

RFID çipi üzerinde bulunan kredi, Etkinlik alanı içerisinde belirlenen noktalarda (bundan sonra “Kabul Noktası” olarak anılacaktır) mal ve hizmet satın almak için kullanılabilir. RFID çipi kullanılarak yapılan ödemelerin tüm durumlarda Kabul Noktalarında mümkün olacağı garanti edilmemektedir.

RFID çipi üzerindeki kredinin ödeme amacıyla kullanılabilmesi için Katılımcılar, RFID çiplerini Kabul Noktasında bulunan POS cihazına yaklaştırmak zorundadır. POS cihazı RFID çipini (yakın alan iletişimi/NFC aracılığıyla) otomatik olarak okur ve çip üzerinde yer alan verileri, kullanılabilir kredi tutarı dahil olmak üzere kontrol ve doğrulama işlemlerinden geçirir.

Verilerin başarıyla kontrol edilip doğrulanmasının ardından, Katılımcı ile ilgili Kabul Noktası arasında satış veya hizmet sözleşmesi kurulmuş sayılır ve ödeme tutarı RFID çipi üzerindeki kullanılabilir krediden düşülür. Her satın alma işlemiyle birlikte RFID çipindeki kredi, borçlanılan tutar kadar azalır. Ödeme işlemi RFID çipi kullanılarak başarıyla gerçekleştirildikten sonra Katılımcılar, işlemi ve ödeme sürecini tek taraflı olarak geri alamazlar.

Ödeme işlemleri, Kabul Noktaları tarafından yetkilendirme kontrolü yapılmaksızın gerçekleştirilir. Ancak RFID çipinin devre dışı bırakılması veya yetkisiz ya da hileli bir işlem yapıldığına dair makul şüphe bulunması halinde, belirli işlemleri reddetme hakkımız saklıdır.

Her türlü iade (örneğin Kabul Noktalarına yönelik şikayetler halinde), RFID çipi üzerindeki bakiyeye kredi yüklenmesi yoluyla gerçekleştirilir.

KULLANICI İLİŞKİSİNİN SONA ERMESİ, KALAN KREDİNİN İADESİ

Etkinliğin sona ermesinden sonra, RFID çipinde kalan tüm kredi 14 gün içinde herhangi bir masraf talep edilmeksizin ve otomatik olarak iade edilir. Söz konusu iade, ilgili Katılımcının RFID çipine yükleme yaparken kullandığı ödeme yöntemine gerçekleştirilir. İade talebi, Etkinliğin sona ermesi ile birlikte doğmuş sayılır.

Katılımcılar ile HYROX World arasında RFID çipinin kullanımına ilişkin kurulan kullanıcı ilişkisi, HYROX World tarafından RFID çipinde kalan tüm kredinin ilgili Katılımcıya iade edilmesiyle birlikte sona erer.

Haklı sebeplerin varlığı halinde, sözleşme ilişkisi hem ilgili Katılımcı hem de HYROX World tarafından derhal feshedilebilir.
